Verpakkingen in Duitsland: dat gaat nét wat anders
Wanneer je
met je webwinkel verkoopt in Duitsland, ben je verplicht om te voldoen
aan ‘VerpackG’. Dit is de nieuwe verpakkingswetgeving in Duitsland die
geldt sinds 1 januari 2019. Deze wet is in het leven geroepen om
duurzaamheid te bevorderen en houdt in dat je belasting moet betalen op
verpakkingen.
In Duitsland geldt sinds 2019 de verpakkingswet VerpackG.
Breng je als ondernemer in Duitsland als eerste een bepaalde verpakking op de markt, dan moet die gerecycled worden. Als dit niet lukt, of wat meer plausibel is: je hebt geen zicht op de recycling, dan kun je dit afkopen. Dat doe je door te betalen aan een afvalbeheerder.
De
verpakkingswet in Duitsland is een tweedelig systeem. Allereerst het
controle orgaan van de centrale overheid, de zogenaamde "Zentrale
Stelle". Zij controleren de verpakkingshoeveelheden die aan de
afvalverwerkers worden doorgegeven. De afvalverwerkers zijn
verantwoordelijk voor de verwerking van de verpakkingen.
Als
e-commerce verkoper in Duitsland ben je wettelijk verplicht je te
registreren bij zowel de Zentrale Stelle als een afvalverwerker.
Vervolgens is het verplicht jaarlijks aan te geven hoeveel
verpakkingsmateriaal er in naam van de organisatie verwerkt dient te
worden. Dit geef je aan bij zowel de Zentrale Stelle als de
afvalverwerker en wordt afgerekend bij de afvalverwerker.
Registreren bij de Zentrale Stelle kan op de website van Lucid: https://www.verpackungsregister.org.
Deze is beschikbaar in het Duits en Engels. Met een gecertificeerd
afvalverwerker naar keuze sluit de onderneming zelf een contract af voor
de afvalverwerking. Zo wordt de Duitse verpakkingsbelasting betaald.
De
verwerkingskosten zijn per afvalverwerker een verschillend. Het systeem
is bij alle afvalverwerkers ongeveer hetzelfde: je geeft je verbruik op
in kilo's per soort verpakking.
Boete van 200.000 euro mogelijk
Er
zijn genoeg Nederlanders webwinkels die via bijvoorbeeld Amazon of
Zalando verkopen aan Duitse consumenten en die niet op de hoogte zijn
van VerpackG. En dat is erg jammer, want dit kan je een hoge boete
opleveren! Wanneer een bedrijf in Duitsland producten verkoopt, moet die
zijn aangemeld in het Verpackungsregister. Wie daar niet in staat, kan
een boete krijgen die kan oplopen tot 200.000 euro. Naast de verplichte
registratie, moet je ook jaarlijks aangifte doen over je verpakkingen.
